Nozu the Fruit Fly
Nozu Terms of Use
In short
- Nozu is free to download. The full unlock is a one-time purchase through Google Play that unlocks all of Nozu's locked content for the Google account that bought it. There is no subscription.
- Purchases are for adults. If a child bought the unlock without permission, contact us and we will arrange a refund.
- Refunds: through Google Play within 48 hours, and after that by writing to us. Wherever you live, you may cancel the purchase within 14 days at no charge.
- Nozu is a game. Some of its reactions come from a simplified simulation built on the wiring map of a real fruit fly; Nozu is not a living fly and has no thoughts or feelings.
- Nothing in these terms takes away rights you have under consumer protection law.
1. About these terms
These terms of use are an agreement between you and ITSNOBODY.NET, the registered business name of Yakov Ganam, 16 Yitzhak Ben Zvi St., Petah Tikva, Israel ("we" or "us"). They cover the Nozu the Fruit Fly app and the Nozu pages at itsnobody.net/NOZU. Please read them together with our Privacy Policy.
Nozu is made for children, but these terms are addressed to their parents and guardians. By installing Nozu or letting a child use it, you accept these terms for yourself and on the child's behalf. If you do not agree to them, please do not use Nozu.
You get Nozu from Google Play, so the Google Play Terms of Service (play.google.com/about/play-terms/) also apply to downloading Nozu and paying for the unlock. Those terms are between you and Google.
2. Your licence to use Nozu
We give you a personal, non-exclusive and non-transferable licence to install Nozu on Android devices that you own or control, and to use it for private, non-commercial purposes, including by members of your family and household, as long as you follow these terms and the Google Play rules. You may not:
- copy, sell, rent or redistribute Nozu or its content, or use them commercially;
- reverse-engineer or modify the app, except as far as the law allows you to despite this restriction;
- get around the purchase, the Settings gate or other technical protections;
- remove or change copyright, licence or credit notices.
Parts of Nozu are made available under open licences (see section 8). Nothing in these terms limits the rights those licences give you.
3. Children, parents and healthy play
Nozu is designed for children aged 6 to 12 who play with a parent's or guardian's permission. You are responsible for supervising your child's use, including how long they play.
Please take regular breaks. A very small number of people may have seizures or feel unwell when they see flashing lights or moving patterns. If you or your child feel dizzy, have eye strain or feel unwell, stop playing and, if needed, see a doctor. Nozu has a reduced-motion setting.
The press-and-hold gate in front of Settings helps keep purchases and settings away from young children, but it is not a parental-control system. Google Play's parental controls and purchase approvals can add protection (support.google.com/googleplay/answer/1075738).
4. The full unlock
Nozu is free to download, and its free version includes a substantial part of the game: in the Smell world (Scent Trail), the tutorial, free play and the first chapter (levels 1 to 10); in every learning world (the worlds of the five learning brains: numbers, words, memory, logic and focus), the tutorial, the first chapter (levels 1 to 10) and its review lessons; the tutorial and first two levels of every other world; the Brain Window and the twin demo; caring for Nozu and the daily discovery; and 8 of the neuron cards and 4 of the 24 wardrobe items.
The full unlock (product full_unlock) is a one-time purchase that permanently unlocks all content in Nozu that is locked in the free version, including locked content added in later updates of the same app. Today this means every level of the 40-level journeys of the six worlds and of every learning world, free play in each of the six worlds, every neuron card and all 24 wardrobe items. Cards, treasures and wardrobe items are still collected by playing: cards are found or lit up in the game, and wardrobe items are chosen with seeds earned in the game.
There is no subscription and no advertising. Seeds, stars and treasures are game rewards earned only by playing. They cannot be bought, sold or exchanged for money, and they have no money value.
The price, including any tax that Google Play collects, is shown in Google Play in your local currency before you confirm the purchase, and that is the price you pay. We may offer a launch price or another temporary price for a limited period; it does not change what the unlock includes. Your bank or card issuer may charge its own fees, for example for currency conversion.
Google Play processes the payment. In the countries where Google is the merchant of record, such as the member states of the European Economic Area and the United Kingdom, Google sells the unlock to you as our agent. Everywhere else, including in Israel, we are the seller and Google Play provides the payment service. In every case, Google Play's purchase process and records apply.
The unlock belongs to the Google account that bought it. It works on any Android device where that account is signed in to Google Play and Nozu is installed. After reinstalling, use Restore purchases in Settings; this needs a connection to Google Play. In-app purchases cannot be shared through Google Play Family Library, and the unlock does not move your pet or progress: use a backup file for that.
Purchases must be made by an adult, or by a minor with the consent of a parent or guardian. If your child bought the unlock without permission, contact us and we will arrange a refund.
Seller details and a summary of the transaction: ITSNOBODY.NET, the registered business name of Yakov Ganam, 16 Yitzhak Ben Zvi St., Petah Tikva, Israel, e-mail support@itsnobody.net. What you buy: the full unlock described in this section, supplied digitally and available in the app as soon as Google Play confirms the payment. Price and payment: the price that Google Play shows before you confirm, paid once through Google Play, which also e-mails you a receipt with the order number. Cancellation and refunds: see section 5.
5. Refunds and cancellation
Within 48 hours of buying, you can usually ask Google Play for a refund directly (support.google.com/googleplay/answer/15574908). After that, write to us at support@itsnobody.net with the Google Play order number (it starts with GPA.). We treat every request fairly, refund whenever these terms or the law require it, and may refund in other cases at our discretion.
Wherever you live, you may cancel the purchase within 14 days of the day it was made. Send us a notice by e-mail to support@itsnobody.net, by post (ordinary or registered) to the address above, or in any other way the law allows, and please include your name and the order number so that we can find the purchase. We will not charge a cancellation fee, and we will arrange the refund to the original payment method within 14 days of receiving the notice. For consumers in Israel, this is also their right to cancel a distance transaction under the Consumer Protection Law, 1981.
Consumers in the European Economic Area and the United Kingdom: when you buy, Google Play asks you to agree that the unlock is supplied immediately and to acknowledge that you therefore lose the statutory right of withdrawal. Our 14-day cancellation promise above still applies to you, and your rights if the unlock is faulty or not as described are not affected.
If Nozu or the unlock does not work as described, please tell us. We will try to fix the problem, and if we cannot fix it within a reasonable time, we will refund you. This is in addition to your rights under the law.
When a refund or cancellation is completed, Google Play revokes the unlock. Your pet and progress stay on your device, but content that belongs to the full version is locked again. The app does this only after Google Play has reported the change for about two days, so that a short Google Play error never locks a real purchase.
6. About the science in Nozu
Nozu is a game, not a scientific instrument, a teaching certification or a source of medical or scientific advice. Nozu is built on the wiring map of a real fruit fly (the MaleCNS v1.0 connectome), and some of Nozu's reactions come from a simplified computer simulation of that wiring.
The simulation leaves out most of what happens in real neurons, uses estimated signs for connections, and connects game events to the wiring in ways we designed. What the Brain Window shows as activity is real output of this model, not a recording from any fly. Card reveals show which cells lit up in the model, and brain moments explain in simple words how a reaction of the model moved Nozu. Scent training is a learning layer we added on top of the fixed wiring. Nozu's needs, moods, rewards and many of his behaviours are designed game mechanics. Nozu is a cartoon character: he is not a living fly and does not have thoughts, feelings or consciousness.
Pictures that are illustrations rather than model output are labelled as illustrations. The scientists who produced the wiring map have not reviewed or endorsed Nozu.
7. Fair use
Please use Nozu only for its intended purpose and in accordance with the law. Do not use it to break the law or infringe anyone's rights, and do not interfere with the app's security or the purchase process. If you discover a security problem, please tell us at support@itsnobody.net.
8. Ownership and open licences
Nozu, including its code, characters, art, animation, music, sounds and texts, is owned by us or licensed to us and is protected by intellectual-property laws. These terms do not give you ownership of any of it.
Nozu also uses material licensed by others, as listed in the Credits: the MaleCNS v1.0 data under the Creative Commons Attribution 4.0 International licence (creativecommons.org/licenses/by/4.0/), the Fredoka and Rubik fonts under the SIL Open Font License 1.1, and software from Google and open-source projects under their own licences. You can obtain the original MaleCNS data from male-cns.janelia.org/ and use it under its licence; these terms do not restrict that.
If you send us ideas or suggestions, we may use them to improve Nozu without any obligation to you.
9. Your data and backups
Nozu stores your pet and progress only on your device, as the Privacy Policy explains, and we have no copy. Uninstalling Nozu or clearing its storage deletes that data permanently. To keep it, export a backup file in Settings and store it safely. Except where the law makes us responsible, we are not responsible for data lost because a device was lost, reset or damaged, or because no backup was kept.
10. Updates and availability
We may update Nozu to fix problems, improve it, add content or comply with the law. We work to keep existing saves working after updates. Some updates may be needed to keep using purchase features.
Nozu needs an Android device with Google Play, running Android 8.0 or later. We cannot promise that it will work on every device or on future versions of Android.
If we stop offering Nozu on Google Play, the copy on your device will keep working offline as far as technically possible, because it does not depend on our servers, and an unlock you bought stays active on that device. We will not use an update to remove content you paid for, unless the law or a third party's rights require it; if that ever happens, we will offer a fair remedy, such as a partial refund.
11. Our responsibility to you
We make Nozu with care but, as far as the law allows, we provide it as it is and as available, without promising that it is free of errors or suitable for every purpose. Nothing in these terms excludes or limits rights or remedies that you have under consumer protection law and that cannot be excluded or limited, such as your rights if the unlock is faulty or not as described.
As far as the law allows, we are not liable for indirect or consequential loss, or for loss caused by events beyond our reasonable control. Where the law allows us to limit our liability, our total liability to you is limited to the greater of the amount you paid for the full unlock and 100 new Israeli shekels.
These limits do not apply to liability for death or personal injury caused by negligence, to fraud or intentional wrongdoing, or to any other liability that the law does not allow us to limit.
12. Governing law and disputes
These terms are governed by the laws of the State of Israel. If you are a consumer living outside Israel, you also keep the protection of the mandatory laws of the country where you live.
If you have a problem, please write to us first at support@itsnobody.net; most issues can be solved quickly. This does not affect your right to go to court at any time.
If you are a consumer, you may bring a claim before any competent court in Israel under the ordinary rules of jurisdiction and, where the law of your country allows it, before the courts of the place where you live. For anyone who is not a consumer, the competent courts in Tel Aviv–Jaffa, Israel, have exclusive jurisdiction.
13. Changes to these terms
We may change these terms, for example when Nozu gets new features or the law changes. A new version will show a new version number and effective date in the app and at itsnobody.net/NOZU, and we will point out important changes in the app before they take effect. Changes apply only from their effective date and will never reduce what a full unlock you already bought includes. If you do not agree to a change, you may stop using Nozu.
14. General
- These terms, the Privacy Policy and the Google Play Terms of Service are the entire agreement between you and us about Nozu.
- If a court finds any part of these terms invalid, the rest remains in force.
- If we do not enforce a right straight away, we have not given it up.
- We may transfer these terms to a business that takes over Nozu, which must continue to honour your unlock. You may not transfer your rights under these terms.
- These terms are published in English, Hebrew, German, French, Spanish and Portuguese. If the versions differ, the version more favourable to you applies.
