NOBODY Files Terms of Use

1. Company, User, eligibility and acceptance

ITSNOBODY.NET, the registered business name of Yakov Ganam, 16 Yitzhak Ben Zvi St., Petah Tikva, Israel (the "Company"), provides NOBODY Files to the person who installs, accesses, creates an account for or uses it (the "User"). The User must be at least 18, have authority over the device and Content, and have legal capacity to accept these Terms. A higher local age or parental-authorization requirement still applies. Creating an account requires affirmative acceptance of Terms version 2026-08-24; the Service records the version and acceptance time. A User acting for an organization confirms authority to bind it.

2. Service and permissions

The Android app scans and organizes files, identifies duplicates and quality signals, recommends cleanup and can move approved items to an app-protected Recycle Bin. You choose whether to grant storage, media, notification, usage-access or other optional Android permissions and can withdraw them in Android settings.

The app's recommendations and AI-generated tags can be wrong. Review every proposed deletion. A Recycle Bin item may become permanently unavailable after its configured deadline, manual permanent deletion, app-data clearing or uninstall. Android scheduling can delay an automatic deadline, and no recovery is guaranteed.

Choosing an external file viewer grants that app temporary read access. Choosing recovery export offers the encrypted database file to the selected share target; the Android app schedules deletion of its temporary FileProvider share-cache copy within 24 hours, while the recipient controls its own copy. Choosing diagnostic sharing sends only minimized, redacted crash structure. The recipient can process or transmit received data under its own terms.

3. Local processing and sensitive classifiers

Media, paths, OCR text, hashes, embeddings, prompts and scan results are processed and retained locally as described in the Privacy Policy; they are not uploaded to the account or billing API. Basic face-presence analysis can create selfie, people and group-photo tags.

Optional Android Face Re-identification can link a person across photos only after separate, versioned consent for photo-library organization. Its photos, temporary crops, biometric templates, groups and names are not sent off the Android device, and the User can delete one person, clear all face data or withdraw consent. The local sensitive-content classifier is advisory. Both can be wrong and must not be used for surveillance, mass identification, discrimination, law enforcement or high-impact decisions.

4. Accounts and security

Provide accurate account information, protect the device and credentials, and notify support about suspected unauthorized use. We may require re-authentication for sensitive actions. You are responsible for activity performed with valid credentials except where applicable law provides otherwise.

Cleanup-credit enforcement sends aggregate requested and actual byte counts and random reservation/idempotency identifiers, not selected file names, paths, per-file sizes or media. Google Play receives an opaque domain-separated SHA-256 account reference, and the service stores its account mapping for verified billing events.

Deleting an account removes the live server-side account and entitlement records described in the Privacy Policy. It does not automatically remove local files or app data from the device and does not cancel a Google Play subscription.

5. Optional models and third-party components

Optional AI model downloads use the internet and may be supplied through Cloudflare or another identified model host. Availability can change. Open-source libraries and model artifacts remain subject to their own notices and licenses; a third-party license does not expand the rights granted by these Terms.

Do not treat captions, classifications, OCR, similarity scores or cleanup recommendations as professional, legal, medical, financial or safety advice.

6. Purchases and subscriptions

The price, billing period, trial or introductory terms, recurring price and included benefits shown by Google Play at checkout control the purchase. An auto-renewing subscription renews until canceled through Google Play. Cancel before the renewal deadline shown by Google Play to avoid the next charge.

Deleting the NOBODY Files account or uninstalling the app does not cancel a Google Play subscription. Manage or cancel it in Google Play's subscription settings. Billing, cancellation, refunds and payment disputes are also subject to Google Play terms and mandatory consumer law.

A one-time cleanup-credit pack is a fixed quota, not unlimited access: 1 GB means 1,000,000,000 bytes. The quota is used when cleanup is committed, is personal to the account, is not transferable or redeemable for cash, and is removed if the account is deleted. We may reverse related credit after a refund, chargeback, revocation or other verified store reversal.

The NOBODY Files Memories subscription grants access to activate and use the on-device Memories model only; it does not include cleanup credit. Starting the subscription starts or schedules local processing, and memories appear progressively. We do not promise that any or all memories will be ready immediately or by a fixed time. Timing and completeness depend on library size and content, device performance, available storage, permissions, battery and thermal conditions, Android background limits, and model availability. Model processing stops when verified Memories access ends. Locally generated data may remain on the device, but Memories access stays locked until entitlement is active again. Cancellation can stop renewal while access already paid for may continue until the verified expiry time.

For a one-time-purchase question or refund request, use the Google Play order/support flow and contact the Company at the support address above. Nothing in this section limits any non-waivable cancellation, refund or other consumer right.

7. Acceptable use

Subject to these Terms, the Company grants the User a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable license to use the App. The User must not use the Service without authority over the device or Content; to surveil, stalk, discriminate or identify people at scale; to violate privacy, confidentiality or intellectual-property rights; to exploit or abuse children; to create prohibited, deceptive or harmful content; to distribute malware; to evade security or billing; or to overload, scrape or probe the API.

The User may report an assistant message without leaving the App. Before submission, the App identifies the generated message, local identifier and selected category that will be sent. The Company may investigate reports, take proportionate safety or support action and retain a report for no longer than 180 days, unless it is deleted earlier with the account or a specific legal preservation duty applies.

8. Availability, suspension and termination

Features and supported models may change. We may suspend access when reasonably necessary to protect users, comply with law, address fraud or security, or respond to a material breach. We will provide notice and an opportunity to remedy where reasonably possible and legally required.

9. Warranties, liability and consumer rights

To the extent permitted by law, the service is provided as available without a promise that recommendations are error-free, every file can be restored, or every device or model remains supported. Nothing in these Terms excludes liability, warranties or remedies that cannot lawfully be excluded, including mandatory consumer protections.

To the extent permitted by law, the Company is not responsible for indirect, incidental, special or consequential loss or loss caused solely by a User-approved action contrary to a clear warning, an unauthorized third party, or circumstances beyond reasonable control.

For liability that may lawfully be limited, the Company's aggregate liability will not exceed the greater of fees paid for the Service in the 12 months before the event or USD 100. This limit does not apply to fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, prohibited limits on confidentiality or privacy liability, or any non-waivable liability.

10. Governing law, changes and contact

These Terms are governed by the laws of the State of Israel, without taking away mandatory consumer protections or mandatory courts available under the law of the User's habitual residence. Either party may contact support@itsnobody.net for informal resolution, without suspending limitation periods or restricting urgent or non-waivable remedies.

We may update these Terms. A material change will use a new version and, where required, will be presented for renewed acceptance before continued account use.
