NOBODY Files — Terms of Use

Version 2026-10-20. Previous versions: https://itsnobody.net/FILES/legal/archive

These Terms are published in Hebrew and in English. If the two versions differ, the Hebrew version prevails, unless mandatory law requires otherwise. Users of the app in other languages read the English version.

In short

1. Who we are and what these Terms are

1.1. NOBODY Files (the "Service") is provided by Yakov Ganam, a sole proprietor registered in Israel under business number 209301860, trading as ITSNOBODY.NET, 16 Yitzhak Ben Zvi St., Apt. 14, Petah Tikva 4937556, Israel ("we", "us" or the "Operator"). You can contact us at support@itsnobody.net, and about privacy at privacy@itsnobody.net.

1.2. The Service consists of the NOBODY Files app for Android and, when it becomes available, for iPhone and iPad (the "App"), our account, purchase and cleanup-credit services, and the pages at https://itsnobody.net/FILES. "You" and the "User" mean the person who installs or uses the App, creates an account or buys a product. "Content" means the photos, videos, files and other information on your device that the App processes at your direction.

1.3. These Terms are a binding agreement between you and the Operator. You accept them when you tick the acceptance box before creating an account or before a purchase, or when you use the Service after they were presented to you. We record the version you accepted, its fingerprint and the time. If you do not agree, do not create an account and do not use the Service.

1.4. The Privacy Policy (https://itsnobody.net/FILES/legal/privacy) explains how we handle personal data and forms part of how the Service works. These Terms, the Privacy Policy and the disclosures shown to you at purchase are the entire agreement between us about the Service.

2. Eligibility

2.1. You must be at least 18 years old and able to enter into a binding contract. If the law where you live requires a higher age or a parent's or guardian's consent, that requirement applies.

2.2. You may use the Service only on devices, accounts and Content that you own or are otherwise lawfully allowed to access. If you use the Service for an organisation, you confirm that you may bind it.

3. What the Service does

3.1. The App scans the photos, videos and files that you allow it to access. It looks for near-identical shots, blurry or dark photos, screenshots, duplicates and large files, explains what it found and recommends what you may want to clean. It can also prepare memories (the Memories feature), show where photos were taken, and, on Android, list apps you have not used for a long time.

3.2. The App's recommendations come from on-device AI models and rules. They can be incomplete, outdated or wrong. They are suggestions, not decisions, and they are not professional, legal, medical, financial or safety advice.

3.3. The Service is not an archive, a backup or a guaranteed recovery system. Keep your own backup of anything important.

4. Your control, the Recycle Bin and permanent loss of files

4.1. The App does not delete, move or change a file without your action. You decide which files to clean.

4.2. On Android, a file you clean is moved to the App's Recycle Bin. You choose how long items stay there, between 1 and 365 days; unless you change it, the period is 30 days. When the period ends, the App deletes the item permanently without asking again. Android may delay that deletion. You can restore an item from the Recycle Bin until it is deleted. If you shorten the period, items already in the Recycle Bin are deleted sooner, and the window for restoring them, and for getting back the cleanup credit used for them (section 10), ends sooner too.

4.3. On iPhone and iPad, a photo you delete through the App goes to the "Recently Deleted" album of the Photos app, where Apple keeps it for about 30 days under its own rules; the App asks iOS to delete it and iOS asks you to confirm.

4.4. A file can be lost permanently, with no way to restore it, when: its Recycle Bin period ends; you delete it permanently or empty the Recycle Bin; you clear the App's data or uninstall the App; on Android, you sign in to a different account on the same device and confirm the deletion described in section 5.4; or the device is lost, reset or damaged. Before you confirm a cleanup, review the selected items.

5. Your account

5.1. You can scan and see results without an account. An account is needed to buy credit or the Memories subscription and to use what you bought.

5.2. Give accurate account information, keep your password and device secure, and tell us at support@itsnobody.net if you suspect that someone else is using your account. We may ask you to sign in again before a sensitive action. You are responsible for actions taken with your valid credentials, except where the law provides otherwise.

5.3. Signing out removes the saved session from the device. It does not delete your account, your purchases or the App's local data.

5.4. On Android, the App's local data (scans, scores, tags, memories, settings and the files in the App's Recycle Bin) belongs to the account that created it. If you, or someone else, signs in on the same device with a different account, the App shows what will be deleted and asks for confirmation. If you confirm, the App permanently deletes the previous account's local data, including the files in the Recycle Bin, and the new account starts with a new scan. This cannot be undone. Files outside the App's storage are not affected.

5.5. You can delete your account in the App (Settings, then Account), on the page https://itsnobody.net/FILES/legal/delete-account, or, if you cannot sign in, by writing to privacy@itsnobody.net from the email address of the account. Deleting the account removes the records described in the Privacy Policy and the remaining credit of the account. It does not delete the App's data on your device, and it does not cancel a subscription (section 9).

6. AI on your device, descriptions and sensitive content

6.1. The App's AI models run on your device. Your photos and files, and what the models find in them, are not uploaded to us.

6.2. The models can estimate whether a photo shows people or pets, so that such photos are kept out of quick cleanup and can be found in search and memories. The App does not detect or count faces, does not create face templates, does not recognise the same person in different photos, and does not group or name people.

6.3. Memories may show short descriptions of your photos. The descriptions were written in advance with the help of AI and are chosen automatically by the on-device model; no person reviews the description chosen for your photo, and it may be inaccurate. You can report a description you find wrong or offensive with "Report this description". The report sends us only the description's number in the description bank and the reason you chose, never the photo, and the App stops showing that description on your device.

6.4. A local classifier marks photos that may be intimate so that they are kept out of the regular results and shown only after you unlock them with your device's lock (fingerprint, face unlock, PIN or password, handled by Android or iOS). The classifier is advisory, can be wrong and never deletes a photo by itself.

6.5. You must not use the App's outputs for surveillance, identifying people, discrimination, law enforcement or any decision that has legal or similarly significant effects on a person.

7. Permissions

7.1. Depending on the features you use, the App asks for access to photos and videos, to all files (Android), to the location recorded in photos, to app usage information and the list of installed apps (Android, for the unused-apps tool), to notifications, to display a small scan window over other apps (Android, optional), and to run in the background. Before it asks for access to all files, to app usage information or to display over other apps, the App explains why it needs it.

7.2. You can refuse or withdraw a permission in the device settings. The related feature may then be unavailable or incomplete; other features keep working where possible.

7.3. On Android, the unused-apps tool can open Android's own uninstall screen for an app you choose; Android asks you to confirm each removal.

8. Cleanup-credit packs

8.1. Scanning and seeing the results are free. Cleaning files with the App's cleanup tools uses cleanup credit, except where the App marks a tool as free (for example, removing unused apps). Credit is bought in one-time packs (for example 10, 25, 50 or 100 GB). The price is the price shown by Google Play (or the App Store) before you pay, including the currency and any tax that the store shows.

8.2. A pack is a fixed quota, not unlimited access: 1 GB means 1,000,000,000 bytes. Credit is used when a cleanup is completed, for the bytes actually cleaned. Credit is personal to your account, is not transferable, cannot be exchanged for money, and is removed if the account is deleted. If a purchase is refunded, charged back, revoked or cancelled under section 11, the credit it gave is removed.

9. The Memories subscription

9.1. The Memories subscription gives access to the App's memories while the subscription is active. The App may prepare memories on your device before you subscribe and may show you one of them; the subscription is needed to open the others. The subscription does not include cleanup credit. Before you subscribe, the store shows the price, the billing period, any trial or introductory offer and the renewal terms.

9.2. The subscription renews automatically for the same period at the price shown by the store until you cancel it. To avoid the next charge, cancel before the renewal date shown by the store. On iPhone and iPad, payment is charged to your Apple Account when you confirm the purchase; the subscription renews unless it is cancelled at least 24 hours before the end of the current period, the renewal is charged within the 24 hours before that end, and any unused part of a free trial, if one is offered, ends when you buy the subscription. Deleting the App or your account does not cancel the subscription.

9.3. Memories are prepared on your device gradually. We do not promise that any or all memories will be ready immediately or by a particular time: it depends on the size and content of your library, the device's performance and storage, permissions, battery and temperature, the system's background limits and the model. When the subscription ends, the memories stay on your device but are locked until the subscription is active again; the App may keep preparing memories on your device.

10. Getting credit back when you restore a cleaned file

10.1. On Android, if you restore a file from the App's Recycle Bin within 30 days after it was cleaned and before it is permanently deleted, the cleanup credit used for that file is returned to the same account. On iPhone and iPad, the same applies when you recover a cleaned photo or video from the "Recently Deleted" album within 30 days after the cleanup and the App finds it back in your library. The return is made once for each cleaned item and never exceeds the credit used for it.

10.2. The return is recorded when the App next connects to our service, and it must be recorded within 37 days after the cleanup. No credit is returned for an item that was deleted permanently or at the end of its Recycle Bin period (or that Apple removed from "Recently Deleted"), that was lost when the App's data was cleared, the App was uninstalled or the account on the device was changed, that was cleaned without using credit, or after the account that was charged was deleted. The return applies to credit from one-time packs.

10.3. A credit return adjusts your cleanup quota only. It is not a refund of money and does not change a payment made through a store.

11. Cancellation, refunds and your rights as a consumer

11.1. Nothing in these Terms limits a right that mandatory consumer law gives you.

11.2. Consumers in Israel: cancelling a purchase within 14 days. If you are a consumer in Israel, you may cancel the purchase of a cleanup-credit pack or of the Memories subscription within 14 days from the day of the purchase, or from the day you received the details of the transaction required by law if that is later, as provided in section 14C of the Consumer Protection Law, 5741-1981, the Consumer Protection (Cancellation of Transaction) Regulations, 5771-2010, and subject to the exceptions they set.

11.3. How to cancel. Send a cancellation notice to support@itsnobody.net from the email address of your account, stating what you bought and when. You can also ask Google Play for a refund through Google Play's own process. We will confirm that we received your notice.

11.4. What happens after a cancellation. We will refund the payment within 14 days after receiving the notice, through Google Play to the original means of payment. To the extent the law allows, the refund may be reduced by a cancellation fee of no more than 5% of the price or ILS 100, whichever is lower, and, for a credit pack, by the value of credit already used. The credit or access that the cancelled purchase gave is removed.

11.5. The Memories subscription can be cancelled at any time. You can cancel it in Google Play (Payments and subscriptions, then Subscriptions), on iPhone or iPad in the subscription settings of your Apple account, or by writing to support@itsnobody.net from the email address of your account. If you write to us about a subscription bought through Google Play, we will stop the renewal within 3 business days after receiving your notice and confirm it by email. Only Apple can stop the renewal of a subscription bought on iPhone or iPad; if you write to us about one, we will tell you how to stop it in your Apple account and handle your request as the law requires. When the renewal stops, access already paid for continues until the end of the current period, unless the purchase is cancelled under section 11.2.

11.6. Purchases on iPhone and iPad are processed by Apple, and Apple handles refund requests for them (for example at reportaproblem.apple.com). If you are entitled to a refund under section 11.2 and do not receive it from Apple, write to us and we will handle your request as the law requires.

11.7. Google Play's and Apple's own refund policies also apply to purchases made through them.

12. Licence and acceptable use

12.1. We give you a personal, limited, revocable, non-exclusive, non-transferable and non-sublicensable licence to install and use the App for its intended purpose. We do not acquire any right in your Content.

12.2. You must not use the Service unlawfully or without authority over a device or Content; infringe privacy, confidentiality, copyright or other rights; surveil, stalk or identify people; exploit or harm children; distribute malware; evade payment or security controls; overload, scrape or probe our services; or, except where the law expressly allows it, reverse engineer the App, extract its models or use it to build a competing dataset, model or service.

13. Third parties and open-source components

13.1. The Service relies on third parties, including Google Play, Apple, Cloudflare, OpenFreeMap (map tiles on Android) and Apple Maps (maps on iPhone and iPad). Their services are governed by their own terms and are outside our exclusive control.

13.2. The App contains open-source software, fonts and model components, each subject to its own licence. The full list, with the licence texts and notices, is in the App under Settings, then Legal, then Licenses and notices. A third-party licence does not extend the rights these Terms give you.

14. Changes, availability and suspension

14.1. We may update, change or stop features, supported devices or models. We may suspend or restrict access when reasonably necessary to protect users or systems, to investigate fraud or a security incident, to comply with the law or because of a material breach of these Terms. Where practicable and required by law, we will give notice and a reasonable chance to remedy.

14.2. You may stop using the Service at any time. Provisions that by their nature should survive the end of the agreement, including sections 15 and 17, continue to apply.

15. Warranty and liability

15.1. To the extent permitted by law, the Service is provided as available, without a promise that every recommendation is correct, that every file can be restored, that every device or model will remain supported, or that the Service will be uninterrupted or error-free. No device or online service can be guaranteed to be completely secure.

15.2. To the extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, for loss of profit or opportunity, or for loss caused solely by an action you approved against a clear warning, by an unauthorised third party or by circumstances beyond our reasonable control.

15.3. Where the law allows liability to be limited, our total liability arising from the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the event and the equivalent of USD 100. This limit does not apply to fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or any liability that cannot lawfully be limited.

15.4. If you use the Service for business purposes, you will indemnify us against a third-party claim caused by your unlawful Content, your intentional misuse of the Service or your material breach of these Terms, except to the extent the claim was caused by us.

16. Additional terms for the iPhone and iPad app

16.1. These Terms are between you and the Operator only, not with Apple Inc. ("Apple"). The Operator, not Apple, is solely responsible for the App and its content.

16.2. Your licence to use the App on Apple-branded devices is also limited by the Usage Rules in Apple's Media Services Terms and Conditions.

16.3. Apple has no obligation to provide maintenance or support for the App.

16.4. The Operator is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App, if any; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.

16.5. The Operator, not Apple, is responsible for addressing any claims relating to the App or your use of it, including product liability claims, claims that the App fails to conform to any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.

16.6. If a third party claims that the App or your possession and use of it infringes that third party's intellectual property rights, the Operator, not Apple, is solely responsible for investigating, defending, settling and discharging that claim.

16.7. You represent that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

16.8. Questions, complaints or claims about the App go to the Operator at support@itsnobody.net or at the address in section 1.1.

16.9. You must comply with applicable third-party terms when using the App. Apple and its subsidiaries are third-party beneficiaries of this section 16 and, once you accept these Terms, Apple has the right to enforce it against you.

17. Governing law and disputes

17.1. These Terms are governed by the laws of the State of Israel, without taking away the protection of mandatory consumer law or the jurisdiction of a court that mandatory law gives you where you live.

17.2. Before starting legal proceedings, either of us may contact the other (we at the email address of your account, you at support@itsnobody.net) and allow a reasonable time to resolve the matter informally. This does not suspend limitation periods or prevent urgent or non-waivable remedies.

18. Changes to these Terms and general provisions

18.1. We may update these Terms when the Service, the law, security requirements or store requirements change. Every change gets a new version date. If a change is material, we will tell you in the App before it applies to you and, where required, ask you to accept it again before your next purchase or continued use of your account. Previous versions remain available at https://itsnobody.net/FILES/legal/archive.

18.2. If a provision is unenforceable, it is limited to the minimum extent necessary and the rest remains in force. Not enforcing a provision is not a waiver. You may not transfer your rights under these Terms without our consent; we may transfer them as part of a transfer of the Service, subject to the notice and privacy obligations that apply.

18.3. The masculine and singular forms used in the Hebrew version apply to all genders and to the plural, and vice versa.
